Amy Kirkland, a North Texas mother, is seeking justice for her family after a fatal crash that took place in August 2022. Her daughter, Katey, lost her life and her husband was injured when a pickup truck crashed into their White Settlement home. Amy has filed a wrongful death lawsuit against multiple people and businesses, according to documents obtained by WFAA.

Donald Gruber, who was charged with intoxication manslaughter and intoxication assault, and Peggy Cox, who faces the same charges, are listed as defendants in the lawsuit. The suit alleges that before Gruber and Cox got behind the wheel, they were served too much alcohol at The Point on Lake Worth, a Fort Worth restaurant and its parent companies, which are also listed as defendants.

According to the lawsuit, Gruber was well-known at the restaurant and was known to drink until he was intoxicated. The lawsuit claims that the restaurant failed to properly train its employees and encouraged them to ignore the law when serving Gruber and Cox, which led to Katey’s death.

The Point on Lake Worth declined to comment on the lawsuit when contacted by WFAA. Amy Kirkland is seeking $1 million in monetary relief.

The tragic loss of Katey has left the Kirkland family devastated. The lawsuit is a step towards holding those responsible accountable for their actions.
